Operator agreement
Between Corelabz Technologies, which runs Wavu, and the business that creates an operator account ("you"). It adds to the terms of service and the privacy notice.
1. Fee
- Wavu costs KES 500 per router per month, unless we agree a different fee with you in writing (it then shows on your Billing page).
- A router is billed from the first full month after it first connects to Wavu. The month it connects is free.
- Bills are made on the 1st of each month and are due 7 days later. Pay by M-Pesa from the Billing page, or as Wavu tells you. Prices include [VAT treatment to confirm].
- We give at least 30 days' notice of a price change.
2. Free trial
We may give you a free trial up to a date shown on your Billing page. No bill is made for a month that starts before that date. After it, normal fees apply unless you remove your routers.
3. Your customers' money
Your customers pay straight into your own Till or Paybill through your own Daraja app. Wavu never holds your money. You handle refunds, receipts your customers ask for, and your own taxes on your sales.
4. Your duties
- Licence. You are responsible for holding any licence the Communications Authority of Kenya requires for the service you provide to the public, and for following its conditions. Wavu doesn't provide that licence. [Applicable licence category to be confirmed.]
- Data controller. You are the data controller for your customers' data, and you tell your customers how it is used (your login page shows your business name and support number). Register with the Office of the Data Protection Commissioner if the law requires it of you.
- Honest selling. Packages must deliver what they say (time, data, speed).
- Your equipment and internet. Your routers, power and internet connection are yours to keep running.
5. Support
We help by WhatsApp and phone on [days and hours], at [support number]. We aim to answer within one working day, sooner when no one on your hotspot can buy. Support covers Wavu, the Wavu set-up on your MikroTik and M-Pesa set-up in Wavu; not general network design or your internet provider.
6. Suspension
- We may suspend your account if a bill is more than [30] days overdue after a reminder, if you break the terms or the law, or if your account puts the service or other operators at risk.
- While suspended you can't sign in and your login page stops selling new packages. Customers who already paid keep their packages until they end.
- We tell you why and how to fix it, and reactivate once it is fixed.
7. Ending
You can stop at any time: remove your routers and pay what is due up to that month. We can end this agreement with [30] days' notice, or straight away for serious breach. On request we give you an export of your data.
