Terms of service
These terms apply to everyone who creates an operator account on Wavu or uses the Wavu console. The operator agreement adds the commercial terms (fees, trials, suspension, support) and the privacy notice explains how personal data is handled.
1. Who we are
Wavu is a hotspot billing service run by Corelabz Technologies [registered name, number and address to confirm], Kenya ("Wavu", "we"). You can reach us at [support email / WhatsApp number].
2. What Wavu does
- Wavu connects your MikroTik routers to a captive portal, sells your internet packages to your customers and lets them pay you by M-Pesa or with vouchers you print.
- Customer payments go straight from your customers to your own Till or Paybill through your own Safaricom Daraja app. Wavu never receives, holds or pays out your customers' money.
- You run your hotspot business. Wavu provides software; it is not an internet service provider to your customers.
3. Your account
- One account per business owner, email address and phone number.
- Give correct details and keep them up to date. You are responsible for everything done with your account and your staff's accounts. Keep passwords secret.
- Lost access? Your account owner (for staff) or Wavu (for owners) can give you a one-time reset link. We may ask you to prove who you are first.
4. Acceptable use
You must not use Wavu to:
- break Kenyan law, including the Kenya Information and Communications Act, the Computer Misuse and Cybercrimes Act and the Data Protection Act;
- sell internet access without any licence the Communications Authority of Kenya requires of you;
- collect payments for something you don't deliver, or mislead customers about prices, speeds or data;
- try to reach another operator's data, attack the service, or get around its limits.
5. Your data and your customers' data
You own your business data. For your customers' personal data (phone numbers, device MAC addresses, usage) you are the data controller and Wavu is your data processor, as set out in the privacy notice.
6. Availability
We work to keep Wavu running all the time but can't promise it never stops. Customers who are already online keep browsing during an outage; new logins and payments may wait until it's back. We announce planned maintenance in advance when we can.
7. Liability
To the extent the law allows, Wavu is not liable for lost profits, lost sales or indirect losses, and our total liability in any 12 months is limited to the fees you paid Wavu in that period. Nothing here limits liability that Kenyan law doesn't allow us to limit. [Liability terms to be confirmed by counsel.]
8. Changes and ending
- We may update these terms. When we do, the console asks the account owner to accept the new version; we tell you about important changes in advance.
- You can stop using Wavu at any time. Ending or suspension is covered in the operator agreement.
9. Law
These terms are governed by the laws of Kenya, and Kenyan courts have jurisdiction.
